Compromise keeps original covenants in place for most owners

Most HOA members reported they liked the 2023 amendments, but were discomforted by the possibility the Declarant could file future amendments with impunity. That concern is now settled as the Declarant has signed a Turnover Letter, putting the HOA Board in control.

Those still opposed to the new amendments sought to preserve their original camping rights in McDowell County (Original Burke County Covenants didn’t allow camping).

The Board’s solution: grandfather all rights in the original Covenants for owners who purchased before September 2023. Additionally, Burke County owners can apply to be governed by the 2023 amendments, which do provide limited camping.
